TERMS & CONDITIONS SCHEDULE These terms and the Promotion Outline together form the “Conditions of Entry” for the Promotion. Capitalised terms have the meaning given in the Promotion Outline unless otherwise stated. If there is an inconsistency between these terms and the Promotion Outline, the Promotion Outline prevails. By submitting an Entry, an entrant agrees to be bound by these Conditions of Entry. The Promoter is Chery Motor Australia Pty Ltd ACN 662 958 205 (“Promoter”, “Chery”, “we”, “us”). Any authorised update to these Conditions of Entry will be made available on the Promotion page. The Promoter will take reasonable steps to ensure that any material change is notified before it takes effect and will not make a change that unfairly prejudices entrants. This Promotion is a game of skill. Chance plays no part in determining the winner. The winner is selected solely by comparative assessment of valid Entries against the Judging Criteria. No random draw, random tie-break, first-past-the-post mechanism or other element of chance will be used. Entry is open only to individuals who satisfy the Eligibility requirements in the Promotion Outline throughout the Period and at the time the Prize is accepted. The Promoter may require reasonable evidence of identity, age, Australian residency, ownership/registration of the Eligible Vehicle and the entrant’s contact details. The following persons are ineligible: (a) directors, officers, employees, contractors and agents of the Promoter or any related body corporate directly involved in conducting or judging the Promotion; (b) employees of any agency or supplier directly associated with administration or judging of the Promotion; and (c) the immediate family members of those persons, being a spouse or partner, parent, step-parent, child, step-child, sibling or step-sibling.An entrant must not enter on behalf of another person or under a false identity. If an Eligible Vehicle is owned by a company, trust, fleet operator, rental business or government body, the driver or employee is not an eligible “owner” unless the Promotion Outline expressly permits that category. Because the Prize is date-specific international travel, an entrant should only enter if they reasonably expect to be available to travel on the Travel Dates. The provisional winner must be legally able to leave Australia, enter and remain in mainland China for the required period, transit any relevant country and return to Australia. The Promoter is not responsible for assessing an entrant’s immigration, citizenship or visa status before judging. To enter, an entrant must complete the Entry Procedure during the Period. Entry is free. The entrant is responsible for ordinary costs of accessing the internet or other entry mechanism. Any vehicle purchase previously made by the entrant is not an entry fee and need not have been made during the Period unless the Promotion Outline expressly states otherwise. Entries received after the Period, incomplete Entries and Entries submitted other than through the authorised mechanism may be rejected. Each entrant may submit only the number of Entries permitted by the Promotion Outline. The Promoter may use its customer, warranty, dealer and vehicle records, and may contact an authorised Chery dealer, to verify Eligible Vehicle ownership or registration to the extent permitted by applicable privacy law. The Promoter may require a provisional winner to provide a copy or extract of registration, purchase documentation or other reasonable proof. Sensitive information that is not required for verification may be redacted. If information cannot reasonably be verified, or is false or misleading, the Entry may be deemed invalid. Entry content requirements. Each Entry must be the entrant’s genuine story and the entrant’s own original work. Statements presented as facts about the entrant’s experience must be true to the entrant’s knowledge and not materially misleading. An Entry must not: (a) infringe copyright, trade mark, privacy, publicity or other rights of any person; (b) include another identifiable person’s image, voice, story or personal information without appropriate consent; (c) contain unlawful, defamatory, discriminatory, obscene, threatening, harassing, dangerous or seriously offensive material; (d) promote illegal conduct or unsafe vehicle use; (e) contain confidential information belonging to another person; or (f) include paid endorsements or third-party advertising not approved by the Promoter. If an Entry includes a person under 18 years of age, the entrant must have the consent of that person’s parent or legal guardian to submit and license that material. The Promoter may require evidence of that consent. The Promoter may reject an Entry that is materially generated by automated means or generative artificial intelligence where, in the Promoter’s reasonable opinion, it undermines the authenticity of the personal story or makes authorship or factual accuracy unable to be verified. Basic spelling, grammar or editing assistance does not of itself invalidate an Entry. If the Promotion is advertised, shared or facilitated through Instagram, Facebook, TikTok or another social platform, the Promotion is not sponsored, endorsed, administered by or associated with that platform unless expressly stated. Entrants must comply with the platform’s applicable terms. Questions and complaints about the Promotion must be directed to the Promoter, not the platform. The Promoter is not responsible for platform outages, algorithmic filtering, private-account settings, deleted content or other platform functionality where Entry is required through a separate official form. The Promoter will appoint a judging panel of at least three persons with suitable experience in marketing, customer engagement, brand communications or another relevant field. Judges may score Entries independently and then moderate scores as a panel. Each valid Entry will be assessed against the Judging Criteria stated in the Promotion Outline. The panel may create a shortlist, verify factual matters and/or conduct a brief interview with shortlisted entrants, provided any additional assessment is applied consistently and relates only to the disclosed Judging Criteria and eligibility requirements. The highest-ranked valid Entry will be the provisional winner. The panel may also rank reserve Entries in descending order for use if the provisional winner is ineligible, cannot be verified, declines or forfeits the Prize. If two or more Entries receive the same overall score, the higher-ranked Entry will be the Entry with the higher score for authenticity and relevance. If still tied, the higher score for storytelling quality and emotional engagement will prevail, and if still tied, originality and creativity will prevail. If a tie remains, the chair of the judging panel will determine the higher-ranked Entry by applying the Judging Criteria only. No tie will be resolved randomly. The Promoter may retain reasonable records of judging, scoring and verification for administration, audit and dispute resolution purposes. Subject to any non-excludable legal right, the judges’ comparative assessment is final. The Promoter is not required to disclose confidential judging deliberations, individual judge notes or commercially sensitive information. The provisional winner will be contacted in the manner set out in the Promotion Outline. The Promoter may publish the confirmed winner’s first name, last initial and State/Territory, and may publish the winning Entry or an edited extract in accordance with clause 18. No entrant should assume they have won until the Promoter confirms eligibility and Prize acceptance in writing. To claim the Prize, the provisional winner must by the Prize Claim deadline: (a) respond to the Promoter; (b) provide requested verification documents; (c) confirm availability for the Travel Dates; (d) nominate one guest; (e) provide the information required for travel booking; and (f) sign any reasonable Prize acceptance, travel, privacy or participation documents consistent with these Conditions of Entry. If the provisional winner does not comply, is ineligible, cannot travel, provides false information, declines the Prize or fails to claim it by the deadline, the Promoter may award the Prize to the next highest-ranked valid reserve Entry. The same process may be repeated until the Prize is awarded or it is no longer reasonably practicable to arrange the trip. The winner may nominate one family member or friend as their guest. Unless the Promoter agrees otherwise in writing, the guest must be an Australian resident aged 18 years or over, must travel from and return to the same Australian departure point as the winner, and must travel on the same itinerary. If the Promoter permits a guest under 18, the winner must be that guest’s parent or legal guardian, or provide all consents and documentation required by the Promoter and applicable authorities, and the winner is responsible for supervising the minor at all times. The guest must satisfy the same passport, visa, immigration, transit, health, insurance, conduct and event-entry requirements that apply to the winner and must sign reasonable guest acceptance and privacy documentation. If the nominated guest becomes unable to travel before ticketing, the Promoter may permit one replacement guest. After ticketing, any change is subject to supplier rules and any additional cost may be the winner’s responsibility. The Prize consists only of the items expressly listed in the Promotion Outline and final written itinerary. Unless expressly stated as included, the Prize does not include: (a) transport to or from the Australian departure airport; (b) passports; (c) visa or visa-waiver costs; (d) travel insurance; (e) vaccinations, medications or medical expenses; (f) travel to obtain travel documents; (g) excess baggage; (h) airline seat selection or upgrades; (i) lounge access; (j) spending money; (k) meals outside the official itinerary; (l) alcohol; (m) minibar or room service; (n) laundry; (o) telephone, roaming or data charges; (p) hotel security deposits; (q) optional tours; (r) personal purchases; (s) tips; (t) taxes imposed personally on the winner; or (u) any other incidental expense.Air travel will be economy class on airlines, routes and flight times selected by the Promoter or its travel provider. Baggage entitlements are those included in the booked fare. Accommodation is one standard twin/double-share room for the winner and guest unless the Promoter confirms otherwise. Any room upgrade or second room requested by the winner is at the winner’s cost and subject to availability. Where meals are included, they are limited to meals arranged as part of the official itinerary. The Promoter and Summit organiser will use reasonable efforts to accommodate dietary requirements notified in advance but cannot guarantee that every dietary preference or requirement can be met in every location. The stated Prize value is an estimate based on information available when the Promotion begins and may vary because of fares, exchange rates, supplier pricing and itinerary changes. Any difference between the estimated and actual value will not be paid in cash. The Prize is not transferable, exchangeable or redeemable for cash. The winner cannot sell, auction, assign or otherwise dispose of any Prize component. Unused components are forfeited and no compensation or credit is payable. Each entrant retains ownership of copyright in their Entry. In consideration of participation in the Promotion, the entrant grants the Promoter and its related bodies corporate a non-exclusive, worldwide, royalty-free, perpetual, irrevocable, transferable and sub-licensable licence to use, reproduce, communicate, publish, display, adapt, edit, translate, subtitle, abridge and otherwise exploit the Entry, in whole or in part, in any media, for the purposes of administering the Promotion, the 2026 User Summit and Chery’s corporate, advertising, publicity, social media and marketing activities. The licence includes use by Chery group entities and appointed agencies in Australia and overseas, including China. The Promoter will not knowingly edit an Entry in a manner that materially misrepresents the entrant’s stated experience. To the extent permitted by law, the entrant consents to acts or omissions in relation to the Entry that would otherwise infringe the entrant’s moral rights, including editing, translation, formatting and publication without attribution. The entrant warrants that they have all rights and consents necessary to grant the licence and that authorised use of the Entry will not infringe any third party right. An entrant agrees that the Promoter may identify them by first name, last initial, State/Territory and social media handle, if relevant, in connection with the Promotion and may use material voluntarily included in the Entry under clause 18. The winner agrees to participate in reasonable publicity directly connected with the Promotion and Prize. Where Chery wishes to create new photography, video, interview or testimonial material featuring the winner or guest beyond incidental event footage, the Promoter will obtain an appropriate separate release/consent before that material is used for broader marketing, unless the use is otherwise authorised by law. The 2026 User Summit may be photographed, filmed, streamed or recorded by Chery group entities, media and event organisers. The winner and guest may appear incidentally in crowd or event footage. Attendance is subject to venue, event, security and accreditation conditions notified by the Summit organiser. Any optional driving, demonstration, factory visit or other activity offered as part of the Summit may be subject to additional safety briefings, licences, waivers or eligibility requirements. The winner or guest may decline an optional activity where reasonably permitted, but no cash compensation is payable for an unused activity. The winner and guest are solely responsible for holding passports with sufficient validity and for satisfying all visa, visa-waiver, immigration, electronic arrival card, customs, quarantine and entry/exit requirements for mainland China and any transit jurisdiction. Requirements can change at short notice and may differ by nationality, citizenship history, passport type or personal circumstances. The Promoter may provide invitation letters or other documents reasonably available to support travel arrangements, but does not warrant that any visa, visa waiver, transit permission or entry approval will be granted. A decision by an airline, immigration authority or other government authority to refuse boarding, entry, exit or transit is outside the Promoter’s control. The winner and guest are responsible for reviewing current Australian Government travel advice and official entry information before departure and during the trip, and for complying with applicable health and safety requirements. Unless the Promoter confirms that comprehensive travel insurance is included, the winner and guest must obtain at their own cost comprehensive international travel insurance covering the entire trip, including overseas medical treatment, hospitalisation, cancellation/disruption and medical evacuation, and provide evidence of cover if reasonably requested. The Promoter may treat failure to obtain required insurance as a failure to satisfy Prize conditions. The winner and guest are responsible for determining whether they are medically fit to travel and for obtaining any medical advice, vaccinations and medication they consider necessary. They must not travel contrary to medical advice. The winner and guest must comply with all applicable laws and lawful directions of government authorities, airlines, hotels, Chery personnel, Summit organisers and security personnel. They must behave safely and respectfully and must not engage in conduct that materially disrupts the trip, Summit, other attendees or Chery operations. Where the winner or guest is removed from a flight, hotel, venue or activity for unlawful, unsafe, abusive or seriously disruptive conduct, the Promoter may cease providing affected Prize components to that person to the extent permitted by law. Any additional costs caused by that conduct are that person’s responsibility. The winner and guest must travel on the dates, routes and bookings arranged by the Promoter. Any request to extend the trip, change flights, change accommodation or deviate from the itinerary is subject to the Promoter’s prior written approval and supplier availability. Any additional fare, tax, accommodation, insurance or other cost caused by an approved personal change is the winner’s responsibility. Frequent flyer points, status credits or other loyalty benefits are subject to the relevant supplier’s rules and are not guaranteed by the Promoter. The Summit program, locations, speakers, activities, airline schedules, hotels and other itinerary elements may change. If an element is unavailable for reasons beyond the Promoter’s reasonable control, the Promoter may replace it with a reasonably comparable alternative or adjust the itinerary, provided the overall Prize remains substantially consistent with the advertised experience where reasonably practicable. If the Summit or Prize Trip is cancelled, postponed or materially affected by circumstances beyond the Promoter’s reasonable control, including government action, border restrictions, epidemic/pandemic conditions, natural disaster, civil disturbance, security concerns, industrial action, airline cancellation or official travel advice that in the Promoter’s reasonable assessment makes the trip unsafe or impracticable, the Promoter may postpone, modify or substitute the Prize or affected component. Where reasonably practicable, any substitute will provide a substantially similar experience or value. Nothing in this clause limits rights that cannot lawfully be excluded, including under the Australian Consumer Law. If the winner becomes unable or unwilling to travel before ticketing or by the booking deadline, the Prize may be forfeited and awarded to the next highest-ranked valid reserve Entry. If the guest alone becomes unable to travel, the Promoter may allow a replacement guest or permit the winner to travel alone, but no cash or other compensation is payable for the unused guest component. After travel has commenced, any missed, unused or forfeited component caused by the winner’s or guest’s personal circumstances is not replaceable except to the extent required by law or covered by their travel insurance. The Promoter collects personal information to receive and assess Entries, verify eligibility and Eligible Vehicle ownership, contact entrants, administer judging, announce the winner, prevent fraud, manage disputes and arrange and fulfil the Prize. Entry is conditional on providing information reasonably necessary for those purposes. Personal information may be disclosed to the Promoter’s related bodies corporate, authorised dealers, agencies, judges, professional advisers, information technology providers and other service providers assisting with the Promotion. Personal information will otherwise be handled in accordance with the Promoter’s Privacy Policy at https://cherymotor.com.au/legal/privacy-policy/ and applicable privacy law. If an entrant becomes the provisional winner, the Promoter and/or its travel provider may need to disclose personal information of the winner and guest to recipients outside Australia, including Chery group entities and Summit organisers in China, airlines, hotels, transport providers, travel agents, technology providers and, where necessary, government or border authorities. Transit-country recipients may also receive booking information. Before making a cross-border disclosure for which express consent is to be relied upon, the Promoter will provide the winner/guest with any notice required by applicable privacy law and seek a specific consent where required. Failure to provide information or a consent that is reasonably necessary to make travel bookings may mean the Prize cannot be provided. Consent to receive direct marketing is not a condition of entry unless expressly permitted by law and clearly stated. Where an entrant separately opts in to marketing communications, the Promoter may contact them in accordance with that consent, the Spam Act 2003 (Cth), the Do Not Call Register Act 2006 (Cth) and the Promoter’s Privacy Policy. An entrant may opt out of marketing without affecting an otherwise valid Entry. The Promoter is not responsible for late, lost, corrupted, incomplete or misdirected Entries to the extent caused by telecommunications, internet, platform or technical failures outside its reasonable control. The Promoter may reject an Entry where there are reasonable grounds to believe the entrant has tampered with the entry mechanism, used automated entry methods, impersonated another person, manipulated verification information or otherwise acted fraudulently. If the Promotion cannot be conducted as reasonably anticipated because of fraud, technical failure, cyber incident, platform failure, unauthorised intervention or another cause beyond the Promoter’s reasonable control, the Promoter may suspend, modify or terminate the Promotion to the extent reasonably necessary, subject to applicable law. Any change will be implemented in a way that is fair to entrants so far as reasonably practicable. Nothing in these Conditions of Entry excludes, restricts or modifies any consumer guarantee, right or remedy conferred by the Australian Consumer Law or any other law that cannot lawfully be excluded, restricted or modified. To the extent permitted by law, the Promoter is not liable for loss, damage, delay, personal expense or disappointment caused by: (a) an entrant’s breach of these Conditions of Entry; (b) a winner’s or guest’s failure to satisfy travel or entry requirements; (c) acts or omissions of airlines, hotels, immigration authorities, event operators or other independent third parties; or (d) circumstances outside the Promoter’s reasonable control, except to the extent the loss was caused by the Promoter’s negligence, breach of contract or breach of a non-excludable legal obligation. The winner and guest remain responsible for their personal possessions and for reasonable care of passports, travel documents and valuables during the trip. Any tax, fringe benefit, reporting or other financial consequence arising from acceptance or use of the Prize is the responsibility of the winner to the extent imposed on the winner by law. The Promoter does not provide tax, immigration, medical or financial advice. An entrant who has a complaint about administration of the Promotion should contact the Promoter at marketing@cherymotor.com.au as soon as reasonably practicable and provide sufficient details to allow the complaint to be investigated. The Promoter will consider the complaint in good faith and respond within a reasonable time. Nothing in this clause prevents an entrant from exercising any right to complain to a regulator or pursue a remedy available at law. Unless expressly stated, airlines, hotels, social media platforms, travel providers and the Summit venue/operator are not promoters of the Promotion and are not responsible for judging or administering it. Their own terms may apply to the services they provide. If any provision of these Conditions of Entry is held to be invalid or unenforceable, it will be read down or severed to the minimum extent necessary without affecting the remaining provisions. A failure by the Promoter to enforce a provision on one occasion is not a waiver of that provision. These Conditions of Entry are governed by the laws of New South Wales, Australia. The parties submit to the non-exclusive jurisdiction of the courts of New South Wales and courts entitled to hear appeals from them.
