T&Cs1)PromoterThe Promoter is Chery Motor Australia Pty Ltd (ACN 662 958 205) of Building F, Suite G.02, 1 Homebush Bay Drive, Rhodes NSW 2138. 2)Promotion periodThe promotion opens at 12:00pm AEST on Thursday 12 March 2026 and closes on Thursday 26 March 2026 at 11.50pm AEST.A shortlist will then be put to final vote, and the winning name will be announced within 30 days of the close of public voting.3) Eligibility3.1 Entry is open to Australian residents aged 18 years or over at the time of entry.3.2 Employees (and their immediate families) of the Promoter and any agencies, suppliers, dealers or companies associated with the promotion are ineligible to enter.3.3 The Promoter may require entrants and/or the winner to provide proof of age, identity and residency. Failure to provide suitable proof may result in disqualification.4) How to enter4.1 To enter, eligible entrants must, during the Promotion Period:(a) submit a proposed name for the upcoming Chery ute; and(b) include a written rationale explaining why the proposed name is suitable, via Chery Motor Australia website4.2 Entries must be received by the Promoter during the Promotion Period.4.3 Only one (1) entry per person is permitted.4.4 Entry is free. Entrants are responsible for any costs associated with accessing the entry mechanism (e.g., internet or mobile charges).5) Entry requirements 5.1 Names suggested cannot be trademark owned or otherwise infringe third-party rights.5.2 Entries must not contain content that is unlawful, misleading, deceptive, defamatory, obscene, threatening, offensive, discriminatory, or that violates any person’s privacy or publicity rights. The Promoter reserves the right to reject an Entry that it considers, in its absolute discretion, to be inappropriate, offensive, misleading, defamatory or otherwise inconsistent with the Promoter’s brand values. 5.3 Entries must be the entrant’s original work (to the extent copyright may subsist in the rationale and/or presentation) and must not include any content copied from another person or source without permission.5.4 The Promoter may, in its absolute discretion, deem an Entry invalid, reject or disqualify an entrant if the Entry does not comply with these Terms & Conditions or the Entry Requirements.5.5 All shortlisted entries will undergo IP and trademark clearance checks prior to publication or public voting.6) Judging (game of skill)6.1 This is a game of skill. Chance plays no part in determining the winner.6.2 Valid Entries will be judged by a panel appointed by the Promoter (“Judges”) at Chery Motor Australia.6.3 Entries will be judged based on originality, creativity and strength of rationale behind the name.6.4 The shortlisted entries will be presented for public voting. The outcome of the public vote will be taken into consideration by the Judges as part of the final evaluation process but will not be determinative. The final winner will be determined by the Judges based on the judging criteria. The Promoter retains final discretion over selecting the winning Entry.6.5 In the case of more than one entry of the same name, the winner will be judged by the accompanying rationale behind the naming.6.6 All decisions of the Judges are final and no correspondence will be entered into.7) Winner notification and publication7.1 The winner will be notified using the contact details provided in their Entry (e.g., email/phone) within [30] days of final poll.7.2 The winner’s name (and suburb/state) may be published on social channels and may remain published for a reasonable period.8) Winner verification, claim and forfeiture8.1 The winner must respond within [14] days of being notified.8.2 The Promoter may require the winner to provide proof of identity, age and residency and to sign any winner documentation (including prize acceptance and publicity releases) within [14] days.8.3 If the winner cannot be contacted, does not claim the prize within the timeframe, fails verification, or is otherwise ineligible, the winner’s Entry may be deemed invalid and the Promoter may award the prize to the next highest-scoring eligible Entry (as determined by the Judges).9) Prize9.1 Prize: One (1) Chery diesel plug-in hybrid ute, including all on-road costs (registration, CTP, stamp duty and dealer delivery).9.2 Exclusions: Unless expressly stated, the Prize does not include insurance, fuel, ongoing servicing, tolls, parking, or any other costs associated with use of the vehicle.9.3 On-road costs: The Prize includes registration, CTP, stamp duty and dealer delivery costs. If not included, these costs are the responsibility of the winner. The winner will be liable for any tax liability associated with the Prize.9.4 Colour/availability: Vehicle colour and/or specifications are subject to availability. Supply and delivery timeframes are subject to manufacturer/dealer availability.9.5 No transfer/cash: The Prize is not transferable, exchangeable or redeemable for cash.9.6 Substitution: If the Prize (or any element of it) is unavailable for any reason beyond the Promoter’s reasonable control, the Promoter may substitute it with a prize of equal or greater value, subject to any applicable legal requirements.10) Publicity and marketing 10.1 Winner agrees to take part in publicity and marketing in connection with the promotion and Prize, including (if requested) being photographed/filmed and participating in reasonable interviews and promotional activity.10.2 The Promoter may use the winner’s name, image, likeness, voice and Entry content for promotional purposes in any media worldwide for 12 months without additional compensation, to the extent permitted by law.10.3 If attendance at a promotional event is required, travel/accommodation costs will be covered by the Promoter (as specified in writing)11) Intellectual property in entries11.1 The entrant agrees that if their Entry is selected as the winning Entry, the entrant assigns to the Promoter all intellectual property rights in the Entry (including the proposed name and accompanying rationale) on creation and agrees to execute any documents reasonably required to give effect to this assignment.11.2 Entrants consent to the Promoter doing (or authorising) any act that may otherwise infringe an entrant’s moral rights in the Entry, including editing, adapting, cropping or using the Entry without attribution, to the extent permitted by law.11.3 Notwithstanding clause 11.1, if the Promoter determines (acting reasonably) that the winning Entry cannot be used as the official name of the vehicle due to legal, regulatory, branding or commercial reasons, the Promoter reserves the right to select an alternative name for the Vehicle. 12) General Terms12.1 If the Competition cannot run for reasons beyond the Promoter’s control (for example, infection by computer virus, mobile network failure, bugs, tampering, unauthorised intervention, fraud, or technical failures), the Promoter reserves the right to cancel, suspend, modify or terminate the Competition. 12.2 By entering the Competition, the entrant understands, agrees and consents to Chery Motor Australia collecting, using and disclosing the entrant's personal information and their entry for the purposes of conducting and administering the Competition in promoting their goods or services, and for further use in accordance with the Privacy Act 1988 (Cth) and the Chery Privacy Policy (available at https://cherymotor.com.au/legal/privacy-policy), without compensation. The entrant consents to Chery (or a third party in accordance with the Chery Privacy Policy) dealing with their entry in any way, including in a way which may infringe the entrant's moral rights.12.3 The Promoter is bound by the Australian Privacy Principles (APPs) in the Privacy Act 1988 (Cth) and by entering this Competition, the entrant is taken to consent to the Promoter privacy policy. Accordingly, the Promoter collects personal information in order to conduct the Competition and may, for this purpose, or any related secondary purpose disclose such information to third parties including but not limited to agents, employees and service providers assisting with this Competition. Entry is conditional on providing this information. The Promoter will keep your personal information for only as long as is necessary to carry out the purpose(s) described above (unless we are required or permitted by law to hold the information for a longer period). The Promoter may use the information for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or telephoning the entrant. All personal information will be collected, handled and dealt with by the Promoter in accordance with the Promoter’s privacy policy at https://cherymotor.com.au/legal/privacy-policy/. Entrants should direct any request to access, update, correct information or opt out to the Promoter.12.4 The Promoter accepts no responsibility for any problems or technical malfunction of any communication network or for any late, lost, incomplete, incorrectly submitted, delayed, illegible, corrupted or misdirected entries, claims or correspondence whether due to error, omission, alteration, tampering, deletion, theft, destruction, transmission interruption, communications failure or otherwise. We have no control over telephone communications, networks or lines and accept no responsibility for any problems associated with them, whether due to traffic congestion, technical malfunction or otherwise. We are not liable for any consequences of user error including any costs incurred.12.5 To the extent permitted by law, the Promoter will not be liable for any loss or damage whatsoever (including direct or consequential loss) or personal injury suffered or sustained in connection with the Prizes or this Competition. The Promoter not responsible for use of a Prize which results in:loss that was not reasonably foreseeable;loss that was not caused by our breach of these Terms and Conditions or by our negligence;business losses (such as lost data, lost profits or business interruptions) or loss suffered by non-consumers;losses caused by factors which could reasonably be considered to be outside our control (such as faults in third party equipment); andany loss caused, or contributed to, by an entrant’s breach of these Terms and Conditions or an entrant’s negligence.12.6 These Conditions of Entry are governed by the laws of New South Wales.
